GENERAL TERMS AND CONDITIONS FOR RENTING A HOLIDAY HOME IN HEIDEBOS OR BETWEEN HEATHLAND AND FOREST
1. Rental period: The relevant contract is concluded for the aforementioned period. The tenant has no right to the property outside this period. In principle, a minimum stay of 2 nights applies.
2. The booking: The agreement is concluded between the lessor (= concessionaire holiday home) and the tenant. The lessor is not liable if the rental cannot continue due to force majeure or unforeseen circumstances.
3. Pricing: The published prices are the prices per holiday home. The prices apply as stated on the website. (subject to printing errors, unless expressly stated in the contract as a price discount). Additional services such as final cleaning and the arrangements are payable separately (optional or mandatory). Please check your contract for this.
4. File costs: No file costs are charged.
5. Advance payment: Upon booking, you pay an advance of 1/3 of the rental price within 7 days. You pay the balance 1 month before arrival. In case of a booking less than 6 weeks before arrival, the full amount must be paid. In case of late payment, Fuarte bv is entitled to unilaterally terminate the agreement.
6. Condition of the property: The holiday home is personally and regularly checked by us. If there are any things that deviate from the description or if there is any damage, you must report this immediately to the person responsible/owner on site, also to avoid this being attributed to you! The problem will then be resolved as quickly as possible. Complaints that are not reported during the stay will not be accepted afterwards. The following things have already been reported and you do not need to report them anymore: Crack in the fruit drawer of the refrigerator, crack in the kitchen window.
You must leave the property in question in the same condition as you found it upon arrival. Any loss due to breakage or damage to the property or contents must be compensated by the tenant. With the rate stated for the final cleaning, we assume that the property is left in a correct condition. In other words, the dishes done, dining table/stove/counter wiped, rubbish in the designated bins, no food leftovers in the fridge or cupboards, barbecue cleaned, no food leftovers in the jacuzzi, no rubbish in the garden, .... If these conditions are not met, additional cleaning costs may be charged.
7. Deposit: You are required to pay a deposit. The amount is EUR 275.00 per stay and must be transferred to the specified account no later than the day before arrival. The owner/person responsible on site has the right to deny you access to the property if this condition is not met. In the event of any damage, this amount to be compensated may be deducted from the deposit. However, one broken glass or plate will not be charged as damage, nor will damage resulting from wear and tear. If the consultation about this damage does not lead to an agreement, the tenant will have to recover the damage directly from the owner. In the event of correct use of the holiday home, the deposit will in principle be returned on the day of departure and no later than 4 days after departure. In exceptional cases, this obligation may be waived (regular returning guests, etc.).
8. Arrival and departure times: It is important that you strictly respect the arrival and departure times (for the exact time, see the documentation of the property).
9. Number of persons allowed: The number of persons occupying the property may not exceed the number stated in the contract. If upon arrival it appears that there are more persons than stated in the contract, the owner has the right to request a surcharge (€40/pp/night for rental price < €1000/week and €80pp/night for rental price > €1000/week) or to refuse the excess persons. The Agency for Nature and Forests also does not permit the placement of tents, mobile homes or caravans. Babies up to max. 2 years old are not counted. Please note that only 1 cot and high chair are available per holiday home.
10. Energy costs (water, gas and electricity): These are included in the rent. Charging electric vehicles is not permitted in any of the homes. The electricity grid is not equipped for this.
11. Accidents: The owner of the property is not responsible for any accidents in and around the property.
12. Cancellation conditions: In case of cancellation by the tenant who did not take out cancellation insurance or who falls outside the terms of the insurance, the tenant is - up to 8 weeks before arrival due to the paid deposit (1/3 of the total sum). - from 8 weeks before arrival the total rental price is due. In case of early departure or not using the house you are not entitled to any refund.
13. Insurance: As a tenant, you are obliged to have appropriate insurance. Any damage to your personal belongings in the event of fire is not covered by the fire insurance of the home. Please consult your insurer yourself to check whether you have appropriate damage coverage for this. You may sometimes need an extension for holiday home of your family and home insurance. As a tenant, you are responsible for damage that is not covered by your insurance. Fuarte bv cannot be held liable for damage suffered by the tenant or third parties as a result of staying in the holiday home.
14. Cancellation by Fuarte bv: If Fuarte bv is forced to cancel the stay due to force majeure (the property is no longer available due to e.g. a death, divorce, fire, or other), you will be informed immediately. The agreement will then be terminated without compensation and with reimbursement of all amounts paid by you.
15. Special conditions: the houses were taken in concession by Fuarte bv from the Agency for Nature and Forests, which owns both houses, and are part of the nature reserve 'Het Nationaal Park Hoge Kempen'. This means that the landlord and tenant must adhere to the regulations in force in the nature reserve and also recognize them:
· Parking is only allowed in the designated parking spaces (2 available)
· The 'grass and forest' zone along the house can be used as a game and play area. The pasture land a little further away is a nature reserve and is intended as a breeding ground for birds, wintering area for insects, butterflies, grazing area for game and may not be entered (at the request of ANB).
16. The activity box is available from 15 February 2025 (for the time being only for the Heidebos holiday home). It must be returned in the same condition. Missing parts or parts that are broken will be deducted from the deposit, as well as not storing properly.
